# Enrollment Terms & Conditions

**Effective Date: October 27, 2026**

These Terms apply prospectively upon publication. Previously accepted transaction terms and existing signed agreements remain unchanged.

These Enrollment Terms & Conditions ("Terms") apply to purchased Memorial Driving School ("Memorial") services and products where applicable to the transaction. They supplement signed driver education enrollment contracts and applicable service-specific purchase documentation; they do not replace a required signed enrollment agreement. General website [Terms & Conditions](https://www.memorialdrivingschool.com/terms-and-conditions) remain separately applicable as described in Section 18.

## 1. Services

Memorial Driving School provides driver education, behind-the-wheel instruction, observation, and related services as offered at the time of enrollment.

Purchased services are identified in the enrollment contract and purchase documentation. Independent online instruction and road tests are described in Sections 10 and 11. Parent-Taught Assistance covers individually purchased BTW instruction only; the authorized parent-taught instructor remains responsible for remaining program requirements.

## 2. Pricing, Payment & Packages

Prices, charges and payment terms are disclosed at purchase and in the enrollment contract. Payment is due as disclosed.

Discounted packages may cost less than their combined individual retail values. The enrollment contract identifies applicable individual service values, total service value, package discount and contract price.

## 3. Cancellations, Rescheduling & No-Shows

At least 24 hours’ notice is required to cancel or reschedule. Late cancellation, no-show, or inability to conduct the lesson because of late arrival or missing required documents, eligibility or corrective lenses forfeits the scheduled service. A $35 no-show fee applies to reclaim and reschedule it. Missed time is not instruction delivered. Mandatory legal rights control.

Exceptions for exceptional circumstances are at Memorial’s discretion; legally required exceptions will be honored.

Separate third-party cancellation and rescheduling terms apply to those services.

## 4. Scheduling

Students and, where applicable, parents/guardians must schedule instruction in time to complete purchased services before the contract deadline.

Enrollment does not guarantee a particular instructor, date, time, appointment frequency, or recurring schedule.

Failure to receive a courtesy reminder does not excuse a missed appointment or applicable fee.

Teen in-car lessons are generally spaced 2–3 weeks apart to allow students to practice outside of scheduled instruction. Actual spacing varies based on student progress and appointment availability.

Teen students must complete 30 hours of additional supervised driving practice, including 10 hours at night, as required by Texas law. This practice is separate from Memorial's instructional hours and must be documented as required by Texas law. This requirement applies only where required for the student’s Texas teen licensing program. The student and supervising adult are responsible for completing and documenting these additional hours; Memorial does not provide, supervise or record them.

Adult students are also encouraged to practice outside scheduled lessons to reinforce their driving skills.

## 5. Classroom Instruction

When classroom instruction is included in an enrollment, students must satisfy all applicable attendance, examination, and completion requirements.

## 6. Enrollment Periods & Expiration

Teen completion periods run from the signed contract’s Effective Enrollment Date. Adult periods run from the Classroom Start Date for in-person classroom programs or the Enrollment Date for online-course and BTW-only enrollments.

Unless the signed contract states otherwise:

Full Teen Program (affiliate 24-hour online classroom + 7 BTW + 7 observation): 8 months

Teen Transfer (7 BTW + 7 observation, less verified eligible prior credits): 6 months

Individual / Additional Teen BTW Instruction totaling 1–4 hours: 3 months

Individual / Additional Teen BTW Instruction totaling 5 or more hours: 6 months

Adult enrollment totaling 1–4 BTW hours: 3 months

Adult enrollment totaling 5 or more BTW hours: 6 months

These are maximum contractual completion periods, not minimum training durations or Texas permit-holding requirements.

Unused Memorial instruction expires at the contract deadline unless Memorial approves an extension or variance under applicable requirements.

## 7. Contract Extensions

Eligible students may request an optional 30-day extension for $50. It must be requested, approved and paid before expiration. Extensions remain subject to Memorial approval and applicable law; expiration creates no automatic right to an extension or reinstatement.

## 8. Cancellation, Termination & Refunds

For regulated driver education, a full refund is due for timely statutory cancellation before midnight of the third day after the enrollment contract is signed, excluding Saturdays, Sundays and legal holidays, unless the student completes the course or fails the course examination. Enrollment procured through provider misrepresentation also requires a full refund. If Memorial discontinues a course and prevents completion, all tuition and fees paid for that course are refundable.

For voluntary course cancellation or termination after the statutory cancellation period:

Refund = amount paid minus full individual retail value of delivered services itemized in the enrollment contract minus one legally permitted $50 course-termination administrative fee. Package discounts do not reduce delivered-service values. Forfeited appointments are not delivered instructional clock hours. Refunds for unused instruction must correspond to actual clock hours not provided; statutory rights control. The $50 fee applies only to course cancellation or termination and is deducted once; the $35 lesson no-show/reclamation fee is separate.

Refunds applicable to independently provided products or services are subject to the applicable provider terms and applicable law.

The effective termination date is the earliest of the last attendance date when Memorial terminates enrollment, receipt of written withdrawal, or the tenth school day after last attendance. Required refunds are completed within 30 days after that date; written refund requests are fulfilled within 30 days after receipt. Eligible separately disclosed extra expenses are refunded as required upon return of Memorial property. Send written withdrawal or refund requests to Memorial’s contact address or email below. Nothing in these Terms limits mandatory legal rights.

## 9. Fees & Additional Charges

| Fee | Amount |
| --- | --- |
| Replacement Certificate | $20 |
| No-show fee to reclaim/reschedule forfeited service | $35 |
| Approved 30-Day Contract Extension | $50 |
| Fuel Surcharge when gasoline exceeds $4.00 per gallon | $5 per applicable lesson |
| Course cancellation/termination administrative fee | $50 once, where permitted by law |

Applicable fees may be required to be paid before additional Memorial services are scheduled or provided, except where prohibited by law.

## 10. Third-Party Online Driver Education

Purchased online driver education is delivered and administered by the independent approved provider identified in the enrollment contract or purchase documentation, currently GetDriversEd.com. That provider is responsible for its course and course documentation; its service-specific terms apply.

## 11. Road Test Services

Road tests are separate from driver education and are administered by a DPS-authorized provider identified in the enrollment contract or purchase documentation, currently Monroy Driving School. Applicable DPS requirements and provider terms apply.

Purchase does not guarantee eligibility to test, a passing score or issuance of a driver license.

## 12. Student Conduct & Safety

Students must follow reasonable instructional and safety directions.

Memorial may refuse, pause or discontinue instruction for unsafe, unlawful or materially disruptive conduct, including suspected impairment, threats, abuse, intentional unsafe conduct or refusal to follow safety directions.

Termination remains subject to the enrollment contract and applicable law. Reentry after conduct-related dismissal is at Memorial’s discretion.

## 13. School Vehicles & Property

Students must use Memorial vehicles, equipment, facilities, and other property appropriately.

A student or customer may be responsible for the reasonable cost of repairing or replacing Memorial property damaged through intentional misconduct, misuse, or negligence.

Students are not responsible for ordinary wear and tear or damage arising solely from the normal risks associated with supervised driver training absent intentional misconduct, misuse, or negligence.

## 14. Electronic Communications & Records

Memorial may send transactional communications to the contact information provided. Customers must keep that information accurate. Electronic contracts, signatures, acknowledgments and records may be used as permitted by law. Marketing communications remain subject to applicable separate consent requirements.

## 15. Third-Party Systems & Services

Memorial may use third-party systems and service providers, whose applicable terms may also apply. Memorial does not control independent providers’ systems; interruptions do not excuse its own contractual duties or mandatory refund obligations.

## 16. Changes To Terms

Memorial may change future services, prices, packages, policies and these Terms. The Terms accepted for a transaction and existing signed contracts are not changed retroactively except by written agreement or as required by law.

## 17. Governing Law & Severability

These Terms are governed by applicable Texas law.

If a provision is determined to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

## 18. Relationship To Enrollment Contract

Mandatory applicable Texas law controls. For regulated driver education, the signed enrollment contract governs the purchased program, and these Enrollment Terms supplement rather than replace it. For standalone services, including road tests, the applicable service-specific terms and purchase documentation govern that service; driver education enrollment requirements, completion periods and course-termination provisions apply only where applicable to the purchased program. Independent-provider terms govern their services, subject to mandatory law. These Enrollment Terms prevail over conflicting general website Terms & Conditions concerning enrollment services, subject to the signed enrollment contract and applicable service-specific terms. General website Terms & Conditions remain separately applicable to website use and communications where appropriate, without retroactively modifying signed contracts or previously accepted transaction terms. Conflicting oral assurances do not modify the agreement unless confirmed in writing.
